India's current must-align baseline for a D2C website/app includes the Digital Personal Data Protection Act, 2023 (consent, withdrawal, user rights, and grievance-first approach); the Digital Personal Data Protection Rules, 2025 (notice format expectations, breach notifications, and processor safeguards); the Information Technology Act, 2000 and SPDI Rules, 2011 (privacy policy publication, SPDI consent and security practice expectations, including ISO/IEC 27001 as an example standard); and the Consumer Protection (E-commerce) Rules, 2020 (disclosures, cancellation charge symmetry, and mandatory grievance timelines).

Common drafting patterns in Indian fashion e-commerce include a friendly but firm tone: broad right to refuse service and cancel orders, reliance on store credits/wallets, narrow return windows with category exclusions, and explicit fraud/abuse refusal language. The Terms below adopt these patterns while staying within Indian compliance constraints, especially around defective/deficient goods and grievance handling.

Legal Requirements and Drafting Constraints in India

Under the DPDP Act, if processing is based on consent, the data principal must be able to withdraw consent with ease comparable to giving it; withdrawal is prospective, and the consequences of withdrawal are borne by the data principal. The Act even gives an e-commerce illustration: if a customer withdraws consent, the service provider may stop enabling future orders but cannot stop processing necessary to fulfil already-paid orders. The Act also requires a user to first exhaust the data fiduciary's grievance mechanism before approaching the Board.

The DPDP Rules, 2025 operationalise how disclosure and breach handling should look in practice. They specify that notice should be presented separately from other information, in clear language, and must provide a means to withdraw consent and exercise rights (including complaint to the Board). They also set breach-notification expectations: the fiduciary must notify affected individuals without delay and notify the Board with breach details and additional reporting within the prescribed hours window (within seventy-two hours).

For older but still practically referenced obligations in Indian online business contracting, the SPDI Rules require publication of a privacy policy and disclosure of data types, purposes, sharing practices, and security practices. They also explicitly permit a body corporate, upon withdrawal of consent or non-provision of data, to choose not to provide the goods/services for which the data was sought, and they contain cross-border transfer conditions for SPDI (same level of protection + contract necessity or consent). The IT Act provides a compensation framework for failure to protect data (Section 43A) and contains confidentiality/privacy offences that support strict confidentiality and access control positions in documentation.

The Consumer Protection (E-commerce) Rules, 2020 impose several Terms-relevant constraints. E-commerce entities must prominently display key identity and contact details (legal name, principal geographic address, website details, and customer care + grievance officer info); must have grievance handling with acknowledgement within 48 hours and redress within one month; and cannot impose cancellation charges on consumers cancelling after confirmation unless similar charges are borne by the entity when it cancels unilaterally. They also prohibit refusing to take back defective/deficient/spurious goods or refusing refund consideration if paid, subject to the rule's conditions.

Key definitions

Products means any goods offered by us on the Platform (including limited drops and sale items). Order means a request placed by you to purchase Products. Store Credits/Wallet means a non-cash, non-transferable credit balance usable only on the Platform, where enabled. Policies include Privacy Policy, Return & Refund Policy, Shipping Policy, and any product-specific terms presented at checkout.

Eligibility and permitted use

You must be competent to contract under Indian law. If you are under 18, you may use the Platform only with a parent/guardian's supervision and consent. You agree to use the Platform only for lawful purposes and in compliance with applicable laws.

Scope of services

The Platform provides services including browsing catalogues, viewing sizing/fit information, placing Orders, payment processing through third-party gateways, fulfilment/shipping/delivery and reverse pickup coordination, customer support, issuance of store credits where permitted, and limited community features where enabled. We may add, change, suspend, or discontinue any part of the Platform or Services at any time, subject to applicable law.

Account registration, security, and suspension

You may be required to create an account to access certain features. You agree to provide accurate and complete information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials/OTP access and for all activity under your account.

We may suspend, restrict, or terminate your account (without prior notice where reasonably necessary) if we believe you breached these Terms or our Policies; your activity indicates fraud, misuse, abuse of returns/refunds, chargeback abuse, COD refusal patterns, reseller activity, or other conduct harmful to our business or other customers; or we are required to do so by law or to protect platform security.

Pricing, content accuracy, and product presentation

Product images are illustrative; colour/texture may vary due to lighting, device displays, and batch differences. Size charts and fit notes are guidance, not a guarantee of personal fit. We reserve the right to correct errors (pricing, descriptions, availability) even after you place an Order. Prices may change without notice.

Order placement, acceptance, and cancellation

When you place an Order, you are making an offer to buy Products subject to these Terms and our Policies. We reserve the right, at our sole discretion, to accept, reject, hold, or cancel any Order for reasons including stock unavailability, verification failure, suspected fraud or abnormal ordering patterns, pricing/content errors, delivery feasibility, repeated returns/refunds/COD refusal patterns, or reseller activity.

An Order is considered accepted only when the Product is dispatched and/or you receive a confirmation stating dispatch/acceptance.

You may request cancellation only before dispatch, subject to the cancellation window shown on the Platform. Once dispatched, cancellation is typically not possible (you may still be eligible for a return/exchange as per the Return & Refund Policy, depending on category and eligibility). We do not charge cancellation fees merely for cancelling, but we may impose operational restrictions if we detect repeated cancellations or COD refusal patterns.

If we cancel an Order unilaterally after confirmation due to reasons attributable to us (e.g., stock errors), we will provide an appropriate remedy consistent with the payment mode and applicable law.

Payments, taxes, and COD rules

Payment methods may include UPI, cards, netbanking, wallets, and Cash on Delivery (COD) depending on location and risk profile. Payments are processed via third-party gateways and we do not store full card details. Prices are inclusive/exclusive of GST as displayed. Invoices are issued as per applicable tax rules.

COD availability is at our discretion and may be disabled for certain pin codes, high-value orders, or accounts showing repeated refusals/returns. Repeated COD refusals or undelivered patterns may lead to account restrictions, disabling COD, or requiring prepaid payment for future orders.

Shipping, delivery, and risk of loss

Delivery timelines are estimates and may vary due to courier capacity, weather, government restrictions, strikes, or other force majeure factors. You are responsible for providing accurate delivery information and ensuring someone is available to receive the order.

If a shipment is returned to origin due to incorrect address, refusal, or repeated failed delivery attempts, we may treat it as a customer-caused failure, process any eligible refund/exchange strictly as per the Return & Refund Policy (including deducting non-refundable shipping/handling where permitted), and/or restrict future service for abuse patterns. Risk in Products may pass to you upon delivery (or attempted delivery, as per courier records), subject to applicable consumer law.

Returns, refunds, and exchanges

Returns, refunds, exchanges, and replacements are governed exclusively by our Return & Refund Policy, which is incorporated into these Terms by reference.

We may require proof for claims (e.g., unboxing video, images of damage/defect, product tag photos). We may reject returns/exchanges where Products show signs of wear, washing, odour, stains, alteration, tag removal, missing accessories/freebies, or other non-compliance with eligibility conditions (unless the claim is for transit damage/defect and supported by evidence). We may impose category exclusions and sale/clearance exclusions as stated on the Platform and in the Return & Refund Policy.

Defective/incorrect goods: Nothing in these Terms removes your statutory rights. Where Products are defective/deficient/not as described, we will provide appropriate remedies consistent with applicable consumer protection rules and our Policies.

Store credits / wallet terms

Wallet credits are usable only on the Platform and are non-transferable and non-encashable; may expire as per the Policy shown at issuance; cannot be redeemed for cash or transferred back to a bank account; and may have additional restrictions during sales/promotions if stated.

Promotions, coupons, and sale events

Coupons, referral codes, and sale events may have separate terms, including category exclusions, limited quantities, no exchange/no return conditions for specific sale items, and restrictions on combining offers. We may cancel promotional benefits where we reasonably suspect misuse, account farming, coupon abuse, or reseller activity.

User content (reviews, comments, submissions)

If you submit reviews, comments, photos, videos, or other content, you represent that you own the rights or have permission to submit it, grant us a worldwide, royalty-free, non-exclusive licence to use and display such content for Platform and marketing purposes, and agree that we may remove content at our discretion if unlawful or objectionable.

Intellectual property

All Platform content (logos, designs, product names, taglines, graphics, images, text, software, UI) is owned by or licensed to Driptopia and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, reverse engineer, or commercially exploit any Platform content without prior written consent.

Prohibited uses

You must not use the Platform for illegal or unauthorised purposes; attempt to gain unauthorised access; introduce malware or scraping bots; manipulate coupons/referrals/checkout flows; impersonate others or use false contact details; harass or abuse staff or delivery partners; or create multiple accounts to abuse promotions or returns.

Third-party services and links

The Platform may include integrations with third parties. We do not control third-party sites and are not responsible for their terms or practices. Your interactions may be governed by their own terms.

Automated decisioning and fraud screening

We may use automated tools to detect suspicious orders, payment anomalies, coupon abuse, and return/refund abuse; decide whether to offer COD; place Orders on hold for verification; and block or restrict accounts showing abuse patterns. Such controls may affect Order acceptance and return/refund eligibility, subject to applicable law.

Privacy, data protection, and communications

Your Personal Data is processed according to our Privacy Policy, which explains data collection, lawful basis/consent, retention, sharing with processors, and your rights. You agree that we may contact you via SMS, WhatsApp, email, or calls for transactional communications. Marketing communications are handled as per Privacy Policy opt-in/opt-out mechanisms.

If you withdraw consent for processing necessary to provide the Platform (e.g., delivery coordination), we may be unable to provide certain services, including enabling future ordering, subject to applicable law.

Disclaimers

The Platform and Products are provided on an as-is and as-available basis, except where expressly stated otherwise. We do not guarantee uninterrupted or error-free access to the Platform.

Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, punitive, special, or consequential damages. Our total liability for any claim relating to an Order will not exceed the amount actually paid by you for the specific Order giving rise to the claim (or such lower cap as permitted by law), excluding non-refundable charges as stated in our Policies. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnity

You agree to indemnify and hold harmless Driptopia, its directors, employees, contractors, and service providers from any claims, losses, liabilities, and expenses arising out of your breach of these Terms or Policies; your violation of applicable laws; your misuse of the Platform; or your User Content infringing third-party rights.

Force majeure

We will not be liable for failure or delay in performance due to causes beyond our reasonable control, including acts of God, flood, fire, pandemic, natural disasters, war, riots, strikes, government actions, internet shutdowns, telecom failures, supply chain disruptions, courier network failures, cyber incidents, or security breaches.

Termination

You may stop using the Platform at any time. We may suspend or terminate access immediately if we suspect breach, fraud, abuse, or risk to Platform security. Obligations that by their nature should survive termination will survive, including IP, disclaimers, limitation of liability, indemnity, and dispute clauses.

Changes to these Terms

We may update, change, or replace any part of these Terms by posting an updated version on the Platform. Your continued use after posting constitutes acceptance of the updated Terms.

Governing law and jurisdiction
